The Industry Dot Biz: I was thinking while watching the tribute. The Jackson’s are brilliant. Michael’s viewing was the day before the tribute at Forest Lawn, the casket at the tribute was closed.   What if there was no body in that casket at the memorial and Michael was still at Forest Lawn? With every member of the worldwide press, a majority of the family and billions of people focused on the memorial, it would have been the perfect time to slip Michael’s body out the backdoor of Forest Lawn and bury him and it would have been in accordance with Michael’s style. His burial place is shrouded in mystery. What do you think?

The charity’s Summer Food Program is a campaign dedicated to letting families in need know about free summer lunches for children at local schools. The Ad Council and Feeding America provided PSAs for Clear Channel Radio to air in 22 targeted markets across the country.

John Hogan, Clear Channel Radio President and CEO, and Lisa Dollinger, Chief Communications Officer, of Clear Channel, along with Peggy Conlon, Ad Council President and CEO, and James Baumann, Senior Vice President, National Accounts & Media Marketing, of the Ad Council, volunteered at the San Antonio Food Bank this afternoon. San Antonio has the largest summer feeding program for children in the country, feeding 10,200 hungry children a day throughout the summer.

Clear Channel was also instrumental in the success of Feeding America’s recent Stamp Out Hunger! national food collection, sponsored by the National Association of Letter Carriers. The organization raised an all-time record of over 73.4 million pounds of food during their May 9th collection drive. Clear Channel radio stations ran over 35,000 15-second PSAs voiced by Ryan Seacrest to support the event.

Katherine Jackson Denied: Industry Exec/Entrepreneur John McClain, Appointed for Michael Jackson’s will but Ailing

The Industry Dot Biz: A judge said Monday that Michael Jackson‘s longtime attorney and a family friend should take over the pop singer’s estate for now, rejecting a request from Jackson’s mother to be put in charge. Los Angeles Superior Court Judge Mitchell Beckloff backed attorney John Branca and music executive John McClain, who had been designated in Jackson’s 2002 will as the people he wanted to administer his estate. Attorneys for the pop singer’s mother repeatedly objected to their appointment at Monday’s court hearing. Jackson died June 25, deeply in debt. But a court filing estimates that his estate will be worth more than $500 million. His assets are destined for a private trust. The singer’s mother, Katherine Jackson, had applied to oversee her son’s estate, but that was before the will surfaced. Her attorney, Burt Levitch, expressed concerns about McClain and Branca’s financial leadership. Levitch told Beckloff that Branca had previously been removed from financial positions of authority by Jackson. Branca’s attorney says he was rehired by Jackson on June 17, days before Jackson’s death. Katherine Jackson did not appear at Monday’s hearing. Branca did attend. Levitch said it was unclear whether McClain would serve as an administrator because he was of ailing health. Attorneys for McClain and Branca described him as having a physical disability but having a completely sound mind. They also noted a decades-long relationship with the Jackson family. Branca and McClain will have to post a $1 million bond on the estate, Beckloff ruled. Their authority over the estate will expire Aug. 3, when another hearing on the estate will be held. “Mr. Branca and Mr. McClain for the next month are at the helm of the ship,” Beckloff said. Katherine Jackson’s attorneys had asked that she be appointed to serve as a co-administrator with Branca and McClain. Beckloff refused to grant that request. The judge granted Branca and McClain several powers over the estate, including the rights to negotiate a settlement with concert promoter AEG Live over refunds for Jackson’s canceled London shows. Beckloff stressed that Katherine Jackson should be given complete information about major transactions, but that he as the judge would grant final approval. John E. Schreiber, an attorney for Katherine Jackson, said, “Frankly, Mrs. Jackson has concerns about hand ing over the keys to the kingdom.” [source]

Harry Lyles Says Cathy Hughes is misleading the public on the Performance Rights Act

Like the rest of the radio industry, I cheered the recent news that the movement in Congress to impose a performance fee on music airplay is almost dead.   A majority of the House and a growing number of Senators have signed the Local Radio Freedom Act, a resolution that denounces any performance fee, tax or other royalty charge on music airplay.

However, over the last few weeks, I have read with great interest (and at times real confusion) the reports and blogs about the controversy generated by House Resolution 848 – the so-called Performance Rights Act ““ the measure that would impose performance fees.   The result is an incredible amount of misinformation regarding black radio and black music performers.

To begin with, some radio execs – who should be more responsible – are making accusations that are inflammatory.   At the epicenter of these charges is a mess created by Cathy Hughes, CEO of Radio One.

While she certainly has the right to express her views about HR 848, Ms. Hughes was completely out of line in what she said on the Baisden Show about Congressman John Conyers (D-Michigan) and the negative inferences she made about his ability to discuss or legislate this bill.

I have worked with Representative Conyers on several issues in the past and have found him to be very intelligent.   His House committee has offered an opportunity to air both sides of the performance tax issue in a fair and rational manner.

Ms. Hughes has also tried to lead the public to believe that this bill targets black radio only and that its passage would put urban stations out of business and financially swamp Radio One.

Once and for all, let’s make sure everyone realizes that this is not a black radio issue.   It’s an issue that impacts the economy of all music radio stations, no matter what format.

However, over the last few weeks, I have read with great interest (and at times real confusion) the reports and blogs about the controversy generated by House Resolution 848 – the so-called Performance Rights Act ““ the measure that would impose performance fees.   The result is an incredible amount of misinformation regarding black radio and black music performers.

There are many wildly successful black radio stations in America.   And there are also a lot of not so successful black stations.   The failing stations need to stop looking for excuses, honestly examine how they are operating and fix their problems.   Maybe they could model themselves after the successful stations and enjoy similar success.   Or maybe give customers what they want and they will beat a path to your door.

Secondly, supporters of HR 848 contend that performers ““ especially minority artists ““ are being slighted because they are not fairly compensated for their work when radio stations play their songs for free.

This argument is hard to swallow.   It’s absurd that performers would blame radio stations for their lack of financial success.   Good business dictates that the best rise to the top and others struggle until they figure out the game.   The best usually get paid the most.   Admittedly, some artists reject the idea of mass appeal.   For that, I salute them and their principles.   But sometimes principals can come at a price.

I am fortunate to have had the chance to meet and get to know many artists.   It appears to me that most of them are very well paid and in most cases deserve it.

We’ve all watched MTV’s Cribs and seen the artists with multi-million dollar estates and garages full of exotic cars.   These people are not suffering and are proudly living the “mega star” lifestyle.   Did radio help them in any way?     Perhaps their success was partially due to massive CD sales triggered by the hits that radio plays.   Maybe it’s partially the result of concerts promoted by local radio, which in turn bring them additional revenue in the sales of t-shirts, hats and other memorabilia.   And it was all made possible by the massive exposure their songs received on radio.   A coincidence? I think not.

Besides, in today’s music industry, black artists are some of the most highly compensated entertainers on earth. Why they would want to change a system that rewards the best is beyond me.

Let’s clarify something else – HR 848 is not going to result in backup singers and studio musicians making more money.   The people in these professions are all paid early on in the process by the artist or the record label.   If you are a back up singer or a musician and you haven’t been fairly paid, then you have a beef with someone, but it is not radio.

The long-stand ing synergy between the radio business and the record industry has worked well for decades.   While not everyone likes the system, it seems to have worked very well for those people who have the talent and skills to rise to the top ““ whether they are radio executives or music performers.   For those whose skills are not as impressive, they find a place in the system at a level commensurate with their work.   This is the way of the world.   Deal with it.

I have seen the Popeye’s Spokeswoman “The Chicken Queen” (Yes, I said the “Chicken Queen”) on several occasions. I personally don’t eat that overly salted sh…, even though the red beans and rice is pretty good, but this woman is repulsive.. This vid is one of the first commercials and while somewhat palatable her current spots have jumped off the ship and gone overboard.. she’s talking like a uneducated, hee haw, thigh slappin’ Harmonica playin’ country Mammy who is willing to breastfeed all the neighborhood childrenz who like titty milk. Dammit, I said, that sh… needs to be pulled IMMEDIATELY. Got my damn pressure up… I’m surprised Popeye’s didn’t go the extra mile and get a 300 pound Black woman with 2 teeth (one on the bottom in the front and one in the back), a doo rag and a picnic table dress and apron with flour and yeast residue from her daily biscuit baking.

The woman is overacting and it’s evident. Several years ago, when I was auditioning in LA I ran into the black guy that used to be the spokesperson for KFC. Nice guy, but he told me he lost the gig because, of all places, people in the south complained about a black man promoting fried chicken and he was nowhere near as hick-ish as the sister doing the Popeye’s commercials now. Just when I thought I had seen enough of this sh…, here comes former BET host Joe Clair going TOTALLY Chicken George in a new KFC commercial for that nasty ass grilled chicken (yes I tried it, it tasted like a chalkboard eraser, but I do love the original recipe when the employees follow the instructions and make it right, which is rare). I’ve met Joe a few times and he’s good people but at the end of the commercial, Joe reluctantly dances with Chicken in hand . Let us pray… Lord, don’t move no mountains… I can tell the racist producers asked him to do that, something that would have gotten them an ass kicking if they had asked me. I don’t give a FOOK about not working in Hollywood again. I said “No.. Joe, don’t dance for the fookin’ chicken” Joe had succumbed to the residual check, racist commercial producers and KFC.. it was too late. I know how racist Hollywood is and how hard it is for Black actors to find work but it would seem Popeye’s and KFC would have a white person pushing the chicken since black people eat that sh… more than anybody else already. Better yet, HIRE A BLACK PRODUCER so that the commercials can be tastefully done and not so fooking insulting you dickheads!!! Then the frosting on the cake… black folks all over the news pissed because Popeye’s didn’t honor the $4.99 special for Thursday. Where’s did I put my Bible?.. Jesus and the Disciples, these people drove from other counties (had to cost them more then $4.99 in gas just to get the special. The news people are having a field day with this. You can look in one of those papers you get in your mailbox, go to the local supermarket chain, catch a WHOLE chicken on sale (even in this economy) for $3.00 and fry that that sh… up yourself.

African-American Pastors to Lead Rally Against D.C. Gay Marriage Vote April 28th

Washington, D.C. ” The D.C. City Council is expected to vote on gay marriage legislation at its next meeting on May 5th furthering the process to recognize gay marriages performed in other states. Bishop Harry Jackson, chairman of the High Impact Leadership Coalition and senior pastor of Hope Christian Church has rallied a broad coalition of pastors, locally and nationally, to lead a rally of local congregations and concerned citizens on Tuesday, April 28th at 11:00 am at the Freedom Plaza across from the DC Mayorâ„¢s office. Å“A group of pastors has set the rally on April 28th as the beginning of our effort to declare that the nationâ„¢s first city is not for gay marriage,  states Jackson. Å“Weâ„¢ve decided unanimously to mobilize our congregations and fellow clergy for the upcoming battle for the definition of marriage. 

Unlike votes in other states, passing the law on May 5th will set in motion a review of the legislation by the U.S. Congress and a potential ballot initiative in the District. Rally information as following:
