Marsh’s attorney, Phillip Masorti, argued at a preliminary hearing Wednesday that prosecutors’ entire case was based on hearsay of the confidential informant who didn’t testify at the hearing.
“There is not one piece of physical evidence,””Masorti said. “Not one piece of direct evidence.”
District Judge Thomas Jordan determined the testimony of a police officer was enough to merit sending the case to trial.
Station operations manager Nick Ferrara declined to comment.
